Bookings
All bookings are subject to Terms & Conditions specified below and to any other conditions by laws and regulations at any time imposed by other companies or persons in respect of the transport, accommodation and all other aspects of the holiday.
In the following conditions the terms “Company” “us” “our” and “we” means Visit Tahiti and the terms “client”, “your” and “you” means the person making the booking and all other passengers on whose behalf he or she makes it. By making the booking, it will be assumed that these conditions have been read and accepted by all passengers.

Our Responsibility
a) The Company accepts responsibility should your holiday not meet the expected standards (provided your expectations are realistic) in respect of holiday packages but not in respect of any flight only arrangements. We will pay you compensation should any part of your holiday arrangements not be as described or through any written amendments, unless there has been no fault on our part, or that of our suppliers and this cause could not have been foreseen or avoided by us or our suppliers even if all due care had been exercised.
b) We accept liability for matters which arise as a direct result of our negligence and/or breach of our contractual duty to exercise care in making arrangements for you, including any acts or omissions by our employees, agents, subcontractors or suppliers whilst acting within the scope or in the course of their employment to provide any service or arrangement forming part of the holiday you have booked with us, including any claim involving death, personal injury or illness. It is however a condition of this acceptance of this liability that you will assign to our insurers or ourselves any rights you may have to pursue any third party. You must also give ourselves and our insurers full co-operation.
It is important to note that travel with a particular carrier will be subject to the conditions of carriage of that carrier, some of which may limit liability.
Operational decisions may be taken by air carriers and airports resulting in delays, diversions or rescheduling. Visit Tahiti has no control over such decisions.

VISAS, PASSPORTS, HEALTH & INSURANCE
Where travel and health documents are necessary to comply with the requirements of any country you may wish to visit or transit through, it is your responsibility to procure them. If failure to obtain any such documents results in fines, surcharges or other financial penalty being imposed on us then you shall reimburse us accordingly. You must ensure by consulting your own GP if necessary of any specific health precautions deemed prudent for the country/resort you intend to visit and the appropriate medication/inoculations complied with.
It is strongly recommended that adequate travel insurance be obtained to cover any unexpected occurrences. Should you elect not to affect such cover then you undertake on behalf of yourself and all members of your party to indemnify us and our overseas representatives and agents (as applicable) against any costs that would arise which would otherwise have been met had you taken out suitable insurance cover.

DEPOSIT
Payment of a deposit at the rate of INR 10,000 per person* must be paid at the time of booking, unless the booking is made within 8 weeks of departure, in which case the full balance will be payable. The deposit, or full payment shall be accepted and credited by the Company as part of the holiday price when the holiday is confirmed by the Company in writing. Should the Company not confirm the booking and a suitable alternative is not considered acceptable, the deposit or full amount will be refunded.
*Due to the complex nature of many of our itineraries, a higher deposit may become applicable, in accordance with our external suppliers. This will be advised to you at the time of booking.

BALANCES
We must receive balances at least 8 weeks prior to departure, unless the booking is made within this time making the balance payable at the time of booking.
If the balance is not paid in full and on time we reserve the right to treat the booking as cancelled by you and apply the relevant cancellation charges as set out in Paragraph 9 – Cancellation. We do not usually send reminders for money we are owed.

PRICES
The price of your holiday is subject to surcharge on the following items for increases in: transportation costs e.g. fuel, scheduled airfares and any other airline surcharges which are part of the contract between airlines (and their agents) and the tour operator/organizer, Government action such as increases in VAT or any other Government imposed increases, currency in relation to adverse exchange rate variations.

ALTERATIONS BY YOU
Providing the ticket rules allow, should you decide to change any details of your booking, a standard amendment fee of INR 3200.00 per person will be charged, plus any additional costs incurred by us or imposed by our suppliers. Alterations and amendments, including name changes, received within 56 days of departure will be treated as a cancellation and the cancellation charges as set out in Paragraph 9 will apply.

ALTERATIONS BY US
TWe reserve the right to make alterations to your holiday – either significant or minor ones. Minor alterations may be made at any time, and if this proves necessary we will advise you as soon as reasonably possible.
In the event of a significant change we shall notify you as soon as it is reasonably possible before your departure and you may either:
- a) Accept the change.
- b) Accept an alternative holiday of comparable type (and paying any supplement or receiving a refund in the event of any price difference).
- c) Cancel your booking and receive a refund of full monies paid to us.

CANCELLATION BY YOU
If after acceptance of booking, you cancel the arrangement or do not pay the balance of the total holiday price by the prescribed time, the Company reserves the right to cancel the booking and to retain the deposit in addition to any amendment charges previously incurred. However, should the cancellation occur within 8 weeks of the departure date, the following cancellation charges will become payable by you:
Period before scheduled departure date within which written instructions are received by the Company Amount of cancellation charge (shown as a percentage of total holiday price) excluding insurance premiums and amendment charges which are non refundable.
56 Days Prior Deposit Only 56 to 43 days 50% 42 to 31 days 80% Within 30 days 100% Cancellation instructions must be given to the Company in writing and the charges are calculated from the date which we receive your written notification. You are advised to insure against the necessity to cancel your arrangements.
Tailor made holidays may have special cancellation charges applied; these will be advised to you at the time of confirmation.

CANCELLATIONS BY US
The Company reserves the right to cancel your holiday in certain circumstances. We will not however cancel your holiday after the date the balance of your holiday price falls due, except where you have failed to make a payment in full and on time, or where we are forced to do so as a result of circumstances beyond our control, including those amounting to “Force Majeure”. If cancellation should occur (other than your default in payment) we shall offer you an alternative holiday of comparable type if available with you paying or receiving a refund in respect of any price difference, or a full refund.

FORCE MAJEURE
Force Majeure is circumstances where the performance of this contract is prevented by unusual and unforeseeable events, the consequences of which could not be avoided even with all due care. Examples of Force Majeure include war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, closure or congestion of airports or seaports, governmental action and all similar events beyond our control.

UNUSED VOUCHERS AND TICKETS
No refunds can be made in respect of any meals not taken when these are included in the holiday price. Refunds on travel tickets, hotel coupons or in respect of additional services such as optional excursions paid for in advance or on the spot, will not be made unless or until credits have been received by the Company from the transportation companies or hotels concerned.

COMPLAINTS AND DISPUTES
In the event of dissatisfaction with any aspect of your holiday, you must report the matter immediately to our local representative and the hotel, cruise company, transport or hire company (whichever is appropriate) Should this action fail to bring about a satisfactory solution and as a result seriously affect the enjoyment of your holiday you must report the matter to the Company by phone or fax within 48 hours so that we are given the opportunity to remedy the problem whilst you are still in residence. Any complaint made to the Company after the holiday must be made in writing to the Company within 1 month of return, giving full details of the departure date, destination and invoice number and sent to the following address:

UNFIT TO TRAVEL
If the Client is prevented from traveling on an aircraft/ship because, in the opinion of any person in authority at the air/sea port (including for example the police, pilot, captain or security personnel), the Client appears by reason of intoxicating liquor or misuse of drugs, either to be unfit to travel or likely to cause discomfort or disturbance to the other passengers, the responsibility of the Company for your journey or holiday including any return flight there upon ceases. Full cancellation charges will then apply and no refunds will be given. Furthermore the Company will then be under no obligation whatsoever for compensation or costs you may incur in respect of or as a result of alternative arrangements you may make.

ACCURACY
Please note that every care has been taken to ensure that the details shown are accurate, but we reserve the right to change any particulars if necessary. We will advise you of any such changes where possible. Please note that all products featured are subject to availability at time of booking.

DATA PROTECTION
In order to process your booking, and to ensure that your travel arrangements run smoothly and meet your requirements, we need to use the information you provide such as name, address, any special needs etc.
We take full responsibility for ensuring that proper security measures are in place to protect your information. We must pass the information on to relevant suppliers of your travel arrangements, such as airlines, hotels, transport companies etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law.
We will not, however pass any information onto any person not responsible for part of your travel arrangements. This applies to any sensitive information that you give to us such as details of disabilities, or dietary/religious requirements.
If we cannot pass this information to the relevant suppliers, we cannot provide your booking. In making a booking, you consent to this information being passed on to the relevant persons.

SPECIAL REQUESTS
If you have any special requests these must be advised to us at the time of booking. We shall endeavour to pass all such requests to our suppliers, although no guarantee can be given that these requests will be met, and failure to do so will not be a breach of contract on our part.

OTHER ITEMS
As soon as you receive your confirmation invoice and tickets please check them carefully, any errors or omissions should be notified to us immediately. We cannot accept liability for your failure to advise us of any inaccuracies in any document within 10 days of us sending it out (5 days for tickets).

LAW AND JURISDICTION
For all claims, disputes of whatsoever nature relating to the Tours coordinated by Visit Tahiti,the courts, forums and tribunals in Delhi, India alone shall have exclusive jurisdiction. All tours are subject to laws, rules of RBI/GOI
